Debt negotiation varies highly depending on your situation. Successfully settling debts usually requires a large lump sum of cash from which to settle your accounts. Some clients think about withdrawing money from their retirement accounts to settle their accounts, but I almost never recommend this. Payment plans can be arranged instead of lump sum, but they almost always involve far less savings overall.
The bankruptcy process begins with a worksheet in my office. I lead you through a checklist and gather paperwork for my office and for the bankruptcy court. I am a bankruptcy lawyer who likes to make individuals aware of alternative solutions when they exist. If we determine that filing bankruptcy is the best strategy to take, I draft your petition and follow up with you about any missing information.
Once the paperwork is prepared and you have completed a credit counseling class online or over the phone, you will sign the petition for filing. I help my clients assess their situation and determine whether to file for Chapter 7 or Chapter 13 bankruptcy.

- Chapter 13 bankruptcy — Is a reorganization bankruptcy that takes your existing debt, restructures it into a manageable payment plan for a period of time before discharging the debt.

In a Chapter 7 bankruptcy, a debtor’s participation is typically wrapped up after one court appearance about five weeks after filing and the discharge is normally issued about three to four months later. This time frame is extended if there are assets to administer. In Chapter 13 cases, you make your first payment 30 days after filing and you receive your discharge three to five years later.
